Prosecutors Seek Jail Time for Bitfinex Hacker

United States prosecutors are pushing for Heather Morgan, also known as the rapper “Razzlekhan,” to serve an 18-month jail sentence. Morgan played a role in laundering 120,000 Bitcoin, which was stolen from the cryptocurrency exchange Bitfinex in 2016.

The Bitfinex Hack and Subsequent Investigation

In a significant move, federal prosecutors filed on October 9 for a lenient sentence for Morgan, citing her “substantial assistance” in her plea deal alongside her husband, Ilya Lichtenstein, in July 2023. Morgan was considered a lower-level participant compared to Lichtenstein and reportedly only used a small fraction of the stolen funds.

Morgan confessed to charges of money laundering and fraud in August 2023. She admitted to aiding in the laundering of the stolen Bitcoin, currently valued at approximately $7.2 billion. While she faces a maximum sentence of 10 years, prosecutors are advocating for a lighter penalty due to her cooperation.

The Role of Ilya Lichtenstein

Initially, both Morgan and Lichtenstein were thought to be solely responsible for laundering the funds. However, Lichtenstein later admitted to being the mastermind behind the hack and the laundering operation. He pled guilty to conspiracy to commit money laundering, facing a potential 20-year sentence.

Morgan’s Involvement and Legal Proceedings

According to prosecutors, Morgan was initially unaware of the origins of the 120,000 Bitcoin but became complicit after Lichtenstein revealed his role in the hack by early 2020. She then assisted in laundering the funds and attempted to conceal his involvement.

Prosecutors emphasized that Morgan’s actions were not impulsive but rather a calculated decision to partake in criminal activity over several years. They highlighted the sophisticated methods used by Morgan and Lichtenstein to obscure their tracks, including the use of non-compliant crypto exchanges, darknet markets, and crypto mixers.

Restitution and Sentencing

In addition to the proposed 18-month sentence, prosecutors have requested that Morgan return the crypto assets seized by the government from the “Bitfinex Hack Wallet.” This wallet holds about 95,000 Bitcoin, 117,400 Bitcoin Cash, 117,400 Bitcoin Satoshi Vision, and 118,100 Bitcoin Gold, collectively valued at over $6 billion.

Morgan’s sentencing is scheduled for November 15, a day after Lichtenstein’s sentencing hearing. The case continues to draw significant attention due to its scale and the high-profile nature of the individuals involved.
