An 86-year-old former lawyer from California has been sentenced to a substantial financial penalty and probation after admitting his role in a large-scale cryptocurrency Ponzi scheme. David Kagel, now residing in a hospice in Las Vegas due to poor health, was ordered by the federal court to pay nearly $14 million and serve five years of probation.

The Ponzi Scheme Unveiled

Between December 2017 and June 2022, Kagel, along with two accomplices, orchestrated a deceptive scheme that promised potential investors high returns with low risk through a cryptocurrency trading program. The fraudulent operation managed to attract at least $15 million from unsuspecting investors who were misled into believing their funds were being used in legitimate crypto trading.

Building Trust with Deception

Kagel exploited his previous status as an attorney to lend credibility to the scheme. He used his law firm’s letterhead to draft letters that falsely assured investors of the legitimacy of the investment opportunity. This tactic was crucial in convincing victims that their money was secure and would yield profits of 20% to 100% within a month.

Legal Consequences and Health Considerations

In May, Kagel pled guilty to conspiracy to commit commodity fraud. Given his advanced age and declining health, prosecutors recommended probation rather than imprisonment. Judge Gloria Navarro concluded that Kagel would serve his probation in his current hospice care, with the condition to wear a monitoring device should he be discharged.

Historical Legal Issues

Kagel’s legal troubles are not new. His law license was revoked in 2023 by the California Supreme Court after he failed to address charges of misappropriating $25,000 in client funds. His license had previously been suspended twice, in 1997 and 2012, indicating a history of professional misconduct.

The other individuals involved, David Saffron and Vincent Mazzotta, have pleaded not guilty and are set to face trial next year in Los Angeles.
