SEC Charges Against TrueCoin and TrustToken

Curve Finance, a decentralized exchange, may remove TrueUSD (TUSD) as collateral for its stablecoin crvUSD. This comes after the U.S. Securities and Exchange Commission (SEC) charged TrueCoin, the issuer of TUSD, with violating securities laws.

In a recent forum post, the cross-chain messaging protocol Wormhole suggested reducing the TUSD collateral limit for crvUSD to zero. The goal is to eliminate regulatory and solvency risks associated with TUSD.

Currently, the “PegKeeper” liquidity pool allows users to mint up to $10 million worth of crvUSD using TUSD. The proposal also recommended lowering the mintable amount of crvUSD with PayPal’s stablecoin, PYUSD, from $15 million to $5 million.

TrueUSD’s Backing Under Scrutiny

On September 24, the SEC settled charges against TrueCoin and TrustToken for fraudulent and unregistered sales of investment contracts involving TrueUSD. The SEC claimed that TrueCoin falsely marketed TUSD as fully backed by U.S. dollars or equivalent assets. In reality, 99% of TUSD’s reserves were invested in a speculative offshore fund.

TrueCoin and TrustToken neither admitted nor denied the allegations but agreed to final judgments preventing further violations of federal securities laws. They were also required to pay civil penalties of $163,766 each.

Implications for Curve Finance

Curve Finance’s crvUSD stablecoin can be minted against several types of cryptocurrency collateral, such as Ether (ETH) and Wrapped Bitcoin (WBTC). WBTC makes up the largest portion of crvUSD’s collateral, with over $68 million in total value locked (TVL). Wrapped Staked Ether (wstETH), a liquid staking derivative from Lido Finance, is the second-largest, with around $60 million in TVL.

The proposal to remove TUSD as collateral highlights concerns over TUSD’s safety and the recent SEC charges. Curve’s governance forum emphasized the need for a diverse range of PegKeepers to mitigate risks.

The proposal calls for a reassessment of crvUSD’s collateral strategy to ensure stability and minimize risks. With TUSD facing regulatory scrutiny, Curve Finance aims to strengthen its stablecoin by diversifying its collateral pool.
